So, as expected, this new document basically took Section I, copied it twice, changed the names from Roxor to RedOctance and MadCatz (respectively), and submitted it as new sections. They basically did the same in the "relief requested" section. It's quite a lot of relief if Konami would win in court (which they almost certainly would); I guess that's to "scare" them into settling out of court.

Well, that's the "Trademark Dilution" section, as well as all those other sections regarding trademark infringement. Those don't seem to be a solid a case as do the patent infringment charges, but what do I know?

Well, the suit itself isn't particularly long or confusing; it's all rather straight-forward. The patent itself though, is another story. It's full of what appears to be a mix of Engrish and legalese.

Anyone else read page 25?

I wouldn't touch DDR if it looked like that, and only two select buttons per side, ew.

EDIT: The screen images are hilarious. *waves to Lady, Afro, bottom scrolling arrows in boxes and two characters that whern't in the game*.

my head hurt after the first 20 pages

if they didnt want this to happen, (as i have said in a fwe other threads) they shouldve made their own new challenging game. Do they think people are going to forget about their dancing game and move on to pac-man?

Well, hopefully it won't ever reach the court as a case, but I can only imagine the look on the legal professionals' faces when they see some of the illustrations (especially the guy who apparently isn't required to obey the law of gravity).

*Looks at page 30* Konami originally wanted to have the arrows scroll down the screen? Interesting. I suppose it's no real surprise considering DDR was the next game after Beatmania. I just find it odd. And what's with that sketch on the machine on page 25? It looks like there's some kind of knob on the machine. o_O *Gets to page 34* Wow, program flow control charts. *Continues reading a little further* Man, it's just pages and pages of really detailed explanation of DDR after those charts. Never thought one could explain DDR in so much text. I guess that sort of thing is necessary for patents, though.

Yeah, my head hutrz. SO much that I can't speel anymore!

Konami's own complaints are supposed to make them sound like the best. Have you read AMD's complaints to Intel? Before the whole conspiracy part of the document they just brag on and on and on... which is actually necessary. Because you can't claim damages if you don't have something valuable to be damaged in the first place. And doubly so for cases of trademark infringment.

Of course, we have Reverse, so they might as well. E10.gif I guess the patent means that you can't make a game where your movement is coordinated by scrolling targets approaching a target area. I don't know what else you could do; maybe some kind of flashing lights?

I can see where Konami has a case against the retro-fitting of DDR cabinets via the Boxor. But against ITG for PS/2? That's shakey, real shakey. Patent court cases historically focus on hardware and hardware which contains software - they will have an uphill climb showing patent infringement in the case of the PS/2. I mean it can be played with a controller E1.gif The court is likely to say "your patent is really on the DDR pad so go sue people who made the pad" or something to that effect. Patents don't apply to software algorithms unless associated with a particular application (software installed in hardware for a particular purpose). This is why the patent itself has all those drawings of the machine - it would have been rejected without some 'physical' content showing the software in action. In the case of the arcade there is an argument, in the case of the PS/2 its like Doom sueing Halo or Mario sueing Sonic the Hedgehog (which I'm sure was considered)

A lot of Konami's claims originate from the idea that ITG~DDR and people might get confused... this thing has a nice "if the marquee had read 'NOT DDR, NOT KONAMI' we wouldn't being seeing any of this" tone. Although Konami clearly would've sued anyways.

Oh yeah, you violate the patent if the game gives you rhythmic instructions on a screen or you require the player to use their feet to 'actuate' an 'actuatable part' (Move something that moves)

They have no right to sue over the concept of triggering sensors by foot (or else Nintendo should be jumping in and suing Konami because of that NES pad, unless that was never patented), they may have the right to sue for timed and sequenced instructions (I think there were games that had you work with timing and sequence, but I don't remember how the instructions were given), but they have the full right to sue you you using the DDR machine or anything that looks or operates in a similar manner.

Whatever, ITG is out, it's not like they can hunt down and destroy every BoXoR in the world... we just might not get new games.

And the original machine design is really wierd... I think I like having a place to put stuff rather than steel towers next to the screen[/quote]
